RETURNS, EXCHANGE AND REFUND POLICY
In store purchases
We trust that you will be delighted with your instore purchase from JW Groombridge Motorcycles. However, in the unlikely event you are not, then the following company policy and procedures are available to resolve your issue.
ITEMS WITH A MANUFACTURING DEFECT
These items are to be returned to us when a defect is identified within the manufacturer’s warranty period and with the original receipt. We will forward these, on your behalf, to the Manufacturer for repair or replacement; whose decision is final. In the event that a repair or replacement is not available, a refund will be offered.
ITEMS WITHOUT A MANUFACTURING DEFECT
Items of Stock Clothing and Accessories, EXCLUDING CRASH HELMETS, purchased through our Clothing and Accessories Departments will be accepted for exchange or credit against a new purchase to the value of the price paid provided that:
- The item was purchased not more than 28 days prior to the return of the item
- The item has not been used, has all the manufacturer labels attached and is in the original packaging
- The original sales receipt is presented upon return
Once these are removed from the premises, Crash Helmets cannot be returned for store credit, exchange or refund. This is a safety related policy. If there is a manufacturing (warranty) issue, then we will follow the ‘Items with a manufacturing defect’ procedure outlined above.
We are unable to give a refund or exchange against the following items
Once removed from the premises, these items cannot be returned for exchange other than when the items are found to have a manufacturing defect not identified or outlined at the time of purchase. We will then follow the ‘Items with a Manufacturing Defect’ procedure above.
PARTS DEPARTMENT SPECIAL ORDER ITEMS
Prepaid Special Order Items cannot be returned for store credit, exchange or refund unless this has been previously agreed with management.
C. Terms and Conditions – Website Transactions.
1. The contract between us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
2. Our right to refuse your order
2.1 We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received by us, if:
2.1.1 We have insufficient stock to deliver the goods you have ordered;
2.1.2 We do not deliver to your area; or
2.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
2.2 If we do refuse your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
3.1 The prices payable for goods that you order are as set out in our website.
3.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.
3.3 All orders are processed in GBP at the prices displayed at time of order.
4. Damaged, Not as described, or faulty on delivery goods
4.1 Goods supplied in a damaged condition, are not as described or found to be faulty upon delivery may be returned for replacement or full reimbursement, whichever is the choice of the customer.
4.2 The full cost of returning goods rejected under these circumstances will be born by us and refunded using the same method of payment as the original transaction.
4.3 If goods are returned for replacement we will pay the cost of transporting the replacement goods to the same address as supplied on the original order request
4.4 If goods are rejected on the basis of one of the above and a full refund requested we will credit the full amount paid including any delivery charge plus the cost of returning the rejected items to us.
5. Right for you to cancel your contract. Online & Distance Sales
5.1 You may cancel your contract with us for the goods you order, at any time up to the end of the 14th day after the date you received the goods. The cancellation period will expire after 14 days from the day on which you acquire, or a third party indicated by you, other than the carrier, acquires physical posession of the goods. In the case of a contract relating to multiple goods ordered in one order and delivered separately the cancellation period ends 14 days after you acquire or a third party indicated by you, other than the carrier acquires the last item of goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.
5.2 To exercise your right to cancel your contract you must inform us of your decision in a clear written statement sent by, e-mail to firstname.lastname@example.org or surface posted letter, addressed to J W Groombridge Motorcycles Ltd , Mayfield Road Garage, Cross in Hand, Heathfield, East Sussex, TN21 0SP. A model cancellation form is provided for use by printing the page on this link cancellation form The model form may be printed or copied, however it is not obligatory to use the form, provided all the required information is supplied to us.
5.3 To meet the cancellation deadline, it is sufficient for you to send your communication to exercise the right to cancel, before the cancellation period has expired.
6. Effects of Cancellation.
6.1 If you cancel a contract we will reimburse to you all payments received from you relating to that contract, including the cost of delivery (but not any supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us).
6.2 We may make a deduction from the reimbursement for loss in value of any goods supplied if the goods are not returned in the same condition as supplied. That is; contained in the original packaging. The packaging to be undamaged, products with all labels, tags, protective film attached and owners handbook and warranty documents, parts, attachments or accessories supplied. We may also make a deduction if the goods have suffered unnecessary handling by you.
Example deductions from original contract price:
Damaged manufacturers packaging 20%
Missing Lables, Tags or protective film and unneccessary handling 50%
Missing parts, documents, accessories, or visible damage to any of the goods 100%
6.3 We will make any reimbursement without undue delay, and not later than:
(a) 14 days after the day we receive back from you the goods supplied under the contract, or
(b) if earlier, 14 days after you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel the contract.
We willmake reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise with us. In any event you will not incurr any fees as a result of the reimbursement.
6.4 We may withold reimbursement until we have received the goods back or you have supplied evidence that you have sent and we have received the goods, whichever is the earliest.
6.5 If you have received the goods in connection with the contract, then:
(a) you shall send them back, or hand them over to us at J.W Groombridge Motorcycles, Mayfield Road Garage, Cross in Hand, Heathfield, TN210SP, without undue delay and in any event not later than 14 days from the day on which you communicated your cancellation of the contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
(b) you shall bear the direct cost of returning the goods to us. If the goods by their nature can not be returned by standard post you will still have to bear the direct cost which may be up to £15.
6.6 It is your responsibility to ensure the goods are packed in a manner to fully protect them whilst in transit back to us.
6.7 You are only liable for any diminished value of the goods resulting from a greater amount of handling than is necessary to establish the nature, characteristics and functioning of the goods.
7. Delivery of goods to you
7.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
7.2 Delivery will be made as soon as possible after your order is accepted. The usual delivery period is 3-5 working days from date of order. In any event goods will be supplied within 30 days of your order.
7.3 You will become the owner of the goods you have ordered when they have been unpacked and accepted by you. Once goods have been accepted by you they will be at your own risk and we will not be liable for their loss or destruction.
8. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
9. Entire agreement
These terms and conditions, together with our current website prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you by us and except where you are dealing as a consumer.

D. Terms and Conditions. Motorcycle Rider Taining Courses
CBT Terms and Conditions
At any point throughout the CBT course the instructor may stop training and ask the student to return another day. This may be due to a variety of reasons. If this is the case the instructor will explain why he/she has chosen to do so and be available to give a full debrief and answer any questions. If you have opted for the Guaranteed Pass option, this means you will not be charged for the first time you return.
If you are required to return for more than one session you will be charged for each subsequent return after the first. This fee and amount will be at the instructor’s discretion, however you may be charged the full CBT price (currently £135) to comeback and finish the CBT.
If you are required to comeback to finish your CBT during peak season (March-November), the appointed day may be a weekday (Monday-Friday) or a weekend day (Saturday – Sunday). The appointed day will be at our discretion. You will not be allowed to return within 7 days, unless specified by your instructor, to do so. CBT Comeback sessions must also be booked in within 3 months of your initial CBT date.
We require 7 days notice if you wish to reschedule your CBT. Failure to give us the required notice period may result in you losing your payment.
If you are booked in for training we reserve the right to charge you the full daily rate if any of the following circumstances apply:
- You fail to keep the appointment.
- You arrive after the appointed start time.
- You are not in a fit and healthy condition to ride a motorcycle.
- You are intoxicated by alcohol or drugs
If you attend the CBT course and at any point during the course you remove yourself from it, for any reason, the course will not be repeated, you will not receive a refund, and you be required to pay the full amount again for a new CBT course.
Occasionally, as a gesture of good will, and if we are able to do so, we will offer to give customers lifts to our training centre. Collections will be from a pre-arranged residential address’ only. If for any reason the person designated to collect the student cannot make the collection on the morning, we will do everything we can to try to contact the student to inform them of the situation so that they can make their own arrangements to get to the training centre. The company, or person designated to collect the student can in no way be held liable should the collection not go ahead. If the student is unable to make their own way to the training centre for their motorcycle training then they must notify us at least 7 days prior to the appointed date. In these circumstances the student will be offered a new date.
Direct Access Terms and Conditions
If you need to cancel or reschedule a Direct Access Course, we require a minimum of 4 weeks notice. Failure to provide us with this notice period may result in you losing your payment. If your tests are cancelled by the DVSA due to unforeseen circumstances, we will still require you to attend your training course. In this instance, we will do our best to find you a cancellation test at short notice.
Whilst we will always endeavour to conduct your test at your local test centre, on occasion we may need to conduct your test at an alternative test centre.
If the weather conditions are adverse, and your motorcycle instructor deems it to be unsafe to ride – they may take the decision not to continue with your training until the weather conditions improve. This decision will only be taken if the instructor feels that student safety may be compromised. It is at the instructors discretion, to decide whether any missed training due to poor weather, or reasons out of their control, will be conducted at a later date.
Training days will last approximately 6 hours, including breaks. Start / Finish times may vary, and if any training is missed it will usually be added on at some point during the course. If you have any questions regarding your schedule, please don’t hesitate to ask your instructor.
All course payments and fees can be refunded 22 days or more before the appointed course commencement date. Payments or fees made for courses booked 21 days or less before the commencement date are non-refundable. Should a dispute arise over training or payments, the matter should be initially discussed with the Chief Instructor. If the matter is not resolved it may be referred to a director.
We are basing the requirements of what course is appropriate on the information supplied by the pupil. The instructor reserves the right not to take the pupil to test if the pupil does not reach a satisfactory standard as deemed by the instructor. If you do not reach the required standard on the CBT part of the course, your DAS training may take place on a smaller bike. This will be conducted at the discretion of the DAS instructor.
Should you be unlucky enough to fail either your Module 1 or Module 2 test with us, you will have the option to book another test with us.
You can choose from the following options:
- Half day of tuition – £100 (& test fee)
- Full day of tuition – £185 (& test fee)
Payment Flow and Delivery Policy
Training courses can be booked up to 8 weeks in advance. Full payment is required at the point of booking.
